Terms of Service

Welcome to Aced. These Terms of Service ("Terms") are a contract between you and Aced ("Aced", "we", "us", "our"), the operator of the aced.app website and related services (the "Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility & Age Requirements

You must be at least 13 years old to use Aced. If you are between 13 and 18 (or the age of majority in your jurisdiction), you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf. We do not knowingly collect personal information from children under 13. If we learn that we have, we will delete it.

2. Your Account

You are responsible for safeguarding your login credentials and for any activity under your account. You agree to provide accurate information and to keep it up to date. We may suspend or terminate accounts that violate these Terms.

3. Educational Use & Academic Integrity

Aced is a study tool. Outputs from our AI features (including the "Homework Solver" and "Humanize" feature) are intended to help you learn, not to be submitted as your own original work where doing so would violate your school's academic integrity policy, honor code, or applicable law. You are solely responsible for how you use any output, including ensuring compliance with your institution's rules. Aced is not liable for academic, disciplinary, or other consequences arising from your use of the Service.

4. AI Output Disclaimer

Our Service uses third-party large language models. AI output may be inaccurate, incomplete, biased, or out of date. Do not rely on the Service for legal, medical, financial, or other professional advice. Always verify important information.

5. Subscriptions, Billing & Refunds

Some features require a paid subscription ("Pro"). Subscriptions auto-renew until cancelled. You may cancel at any time from Settings; cancellation stops future renewals and you keep Pro access through the end of the current billing period. Prices may change with notice.

Our order process is conducted by our online reseller Stripe. Stripe Payments Europe, Ltd. and its affiliates ("Stripe") act as the Merchant of Record for all our orders. Stripe handles billing, invoicing, sales tax, and processes returns and refunds on our behalf. By purchasing, you also agree to Stripe's Consumer Terms of Service.

6. Acceptable Use

You agree not to misuse the Service. See our Acceptable Use Policy for details, including prohibitions on unlawful content, abuse, scraping, and reverse engineering.

7. User Content

You retain ownership of the notes, questions, and other content you submit ("User Content"). You grant Aced a worldwide, non-exclusive, royalty-free license to host, process, and transmit your User Content solely to provide and improve the Service. We do not sell your User Content.

8. Intellectual Property

The Service, including its design, code, trademarks, and logos, is owned by Aced or its licensors and is protected by intellectual property laws. We grant you a limited, revocable, non-transferable license to use the Service for personal, non-commercial study purposes.

9. Termination

You may delete your account at any time from Settings. We may suspend or terminate your access if you violate these Terms or applicable law. Sections that by their nature should survive termination (e.g., disclaimers, liability limits) will survive.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT AI OUTPUT WILL BE ACCURATE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ACED AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL. OUR TOTAL LIABILITY ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR (B) USD $50.

12. Indemnification

You agree to indemnify and hold harmless Aced from any claims arising out of your User Content, your use of the Service, or your violation of these Terms or applicable law.

13. Governing Law & Disputes

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict of laws rules. Disputes will be resolved in the state or federal courts located in Delaware, except where prohibited by law. You and Aced each waive any right to a jury trial.

14. Changes

We may update these Terms from time to time. Material changes will be communicated through the Service. Continued use after changes take effect constitutes acceptance.
